The employment probationary period is a time during which the employer assesses whether the employee is suitable for the job for which the employment contract was established. At the same time, it gives the employee an opportunity to see if the job and working conditions are suitable for them.
HOW LONG DOES THE PROBATIONARY PERIOD LAST?
The law doesn't specify a minimum duration for the probationary period, but it clearly states that the maximum period can't exceed six months. It is important that the period is long enough for the employer to make an objective decision about the employee's abilities.
The probationary period is only applied when establishing the employment relationship, but not when transferring the employee to another position.
IMPORTANT: EMPLOYEES MUST BE REGISTERED FOR INSURANCE DURING THE PROBATIONARY PERIOD
HOW IS THE EMPLOYEE ASSESSED?
The employer makes the final decision about whether the employee meets expectations. To ensure an objective assessment, it is recommended that the employer define clear rules and evaluation criteria in advance.
If the employee doesn't meet expectations during the probationary period, their employment ends on the day the probationary period expires.
POSSIBILITY OF TERMINATING THE CONTRACT
The probationary period doesn't have to last until the end of the designated period – both the employer and the employee can terminate the employment contract earlier, with respect to a notice period of at least 5 days.
If the employer decides to terminate the contract, they are required to provide the employee with specific reasons for such a decision.
RIGHTS AND OBLIGATIONS DURING THE PROBATIONARY PERIOD
During the probationary period, the employee has the same rights and obligations as other employees. This means that their employment may be terminated not only due to bad results on the probationary period, but also for other reasons, such as a serious violation of work duties.
The probationary period is an important mechanism in the employment process as it allows the employer to find a suitable worker, while also giving the employee an opportunity to assess whether the new position is right for them. Therefore, it is crucial that this period is used in a way that ensures an objective evaluation and fair working conditions.
