Maternity leave in Montenegro

Unlike pregnancy leave, which an employed woman can take to maintain her pregnancy, maternity leave can be initiated no earlier than 28 days before the expected delivery date, which is determined by the chosen doctor.

Maternity leave lasts until the child turns one year old.

1. PROCEDURE AND DOCUMENTATION

An employed woman (mother) receives a certificate regarding the start of maternity leave from the chosen doctor, which must be submitted to the employer. Based on this document, the employer has the right to submit a request for reimbursement of the salary paid to the employee during maternity leave.

2. SALARY REFUND

The reimbursement amount is based on the average gross salary of the employee for the previous year.

NOTE: If the request for a refund of the salary during maternity leave is submitted within 30 days from the start of the right to leave, the payment will be made from that day. If the request is submitted after this period, the payment will be made from the day the request is submitted.

3. REQUEST PROCESSING

The documentation is submitted to the Center for Social Work, which has approximately one month to process the request and deliver the decision to the employer. It is important to note that the employer cannot terminate the employment contract with an employee who is on maternity leave for as long as her leave lasts.

The law allows fathers to "take over" maternity leave from the mothers, but only after 70 days from the child's birth. The mother can then return to work, and the father takes over the care of the baby and uses leave for childcare. Most fathers are unaware that this option is available to them.
