How to Make Sure the Market Inspector Leaves Empty-Handed?
If you are engaged in retail or wholesale, a market inspector may visit your premises without any prior notice to check whether you comply with legal obligations.
To be prepared for this visit, you must have the following:
- Store registration
- Store records
- Complaint book
- Inventory list as of December 31st
- Clearly displayed product prices and prices per unit of measure
- Prices of products before and after discounts or promotions
- Notifications about the goods or services, certificates of conformity, user manuals, assembly instructions, warranty cards, technical instructions, list of authorized service centers, warnings about potential hazards during use, etc. (in Montenegrin language)
- Clearly displayed payment methods
- Clearly displayed instructions on how to file complaints
- Clear notice prohibiting the sale of alcoholic beverages and tobacco products to minors
- Clear notice about not issuing receipts
- Clear notice about the prohibition of smoking on the premises
- Clearly displayed price of consumer bags and their declaration (The seller must have the specification for the bags from the supplier, and this document must be kept in the documentation)
- Clearly displayed notice with product information
- Clearly marked products with defects, damage, or near expiry date, etc.
- The trader is required to visibly mark products that are on display in the store but are not for sale, with labels such as "not for sale," "sample," or "exhibit"
- Decision on appointing a person authorized to accept complaints
- Decision on the deposit
- Proof of payment for daily sales (Payments for daily sales (cash) must be made to the bank account no later than the next day for the previous day)
WHAT CAN THE INSPECTOR CHECK?
In addition to the above, the market inspector may check:
- Whether product prices are compliant
- Whether you conduct the inventory correctly
- Whether you charge for consumer bags at the checkout
- Whether you have clearly marked discounted or promotional products, and whether you have a clearly displayed Decision with the exact duration of the discount or promotion
- Whether you use and sell plastic bags with a thickness of 15 to 50 microns, which are prohibited by the Waste Management Act
