Extension of temporary residence and work permit: A guide for employers and employees in Montenegro

Extending a temporary residence and work permit can be a stressful process, but with proper preparation and timely submission of documentation, everything can be completed without problems.

WHEN TO SUBMIT A REQUEST FOR PERMIT EXTENSION?

After the current temporary permit expires, it is necessary to submit an application for the extension of the permit. This must be done no later than one day before the existing permit expires, and it is possible to apply up to one month before the permit expires.

Our advice: Don’t wait until the last minute, as delays in submitting documentation can lead to the loss of the right to extension.

DURATION OF THE NEW PERMIT

The permit lasts for the next year or three months before the expiration of the passport (if the passport expires within one year after applying for the permit extension).

HOW LONG DOES IT TAKE TO ISSUE A PERMIT?

After submitting the complete documentation, the Ministry of Interior needs 15 days to issue a new permit.

RULES FOR EXECUTIVE DIRECTORS

Executive directors (provided they are founders of more than 51% of the company) have the right to extend the permit four more times continuously after the issuance of the first permit. After that period, they can apply for a permanent permit, which lasts five years.

This rule facilitates long-term planning for executive positions and reduces the need for frequent applications.

RULES FOR EMPLOYEES

Employees who are not in executive director positions can extend their work permit two more times continuously after the expiration of the first permit. After that, they must take a break before reapplying for a new permit.

THE RESIDENCE PERMIT CANNOT BE EXTENDED IF YOU HAVE NOT SETTLED ALL TAX OBLIGATIONS FOR THE COMPANY AND EMPLOYEES.

WHAT HAPPENS IF YOU DO NOT SUBMIT A REQUEST ON TIME?

If the request for the extension of the residence and work permit is not submitted within the prescribed period, the right to extension is lost. When applying next time, you will need to submit the complete documentation as you did when applying for the first permit.
