Employment Contract – Fixed-Term and Indefinite Duration

The Employment contract is a key document that regulates the working relationship between the employer and the employee. Understanding the duration of the employment contract is very important for both employers and employees.

In this blog, we will consider the key aspects related to the duration of the employment contract, as well as the rights and obligations of both employees and employers.

CONCLUSION OF CONTRACT

The employment contract is concluded with the employee before they start work, and it can be concluded for a fixed or indefinite period of time. There is no minimum period for concluding an employment contract.

FIXED-TERM CONTRACT

A fixed-term employment contract is one where the end date is predetermined. An employer may conclude multiple fixed-term contracts with the same employee, but for no longer than 2 years. If there is a break of less than 70 days between contracts within this 2-year period, it will be considered as if there was no break.

Internships, maternity leave, and parental leave are not included in the 2-year period.

A fixed-term employment contract will last until the end of the term for which it was concluded or until the employer or the employee cancels it.

TRANSITION FROM A FIXED-TERM TO A INDEFINITE DURATION

After 2 years of employment, the next contract that must be concluded is a permanent one (at any point in the future), except in specific cases such as replacing a temporarily absent employee, performing seasonal work, or working on a project until its completion.

A permanent employment contract will last until it is terminated by either the employer or the employee.

EMPLOYEE RIGHTS

An employee who has concluded a fixed-term employment contract has the same rights, obligations, and responsibilities as an employee with a permanent contract.
